Us to issue Visa Bans for Foreign Nationals Who ‘Censor’ Americans, Rubio Says – Reuters

On May 28, 2025, U.S. Secretary of State Marco Rubio announced a new visa restriction policy targeting foreign nationals who engage in censorship of Americans’ protected speech, particularly on social media platforms. The policy, grounded in Section 212(a)(3)(C) of the Immigration and Nationality Act, deems such individuals inadmissible to the U.S. due to “serious adverse foreign policy consequences.” Rubio emphasized that it’s unacceptable for foreign officials to issue or threaten arrest warrants for social media posts made by U.S. citizens or residents on American platforms while on U.S. soil, or to demand that U.S. tech companies adopt global content moderation policies that extend beyond their authority into the U.S. The policy may also apply to family members of those involved in censorship.

While Rubio didn’t name specific targets, he hinted at focusing on officials regulating U.S. tech companies, with posts on X suggesting potential action against figures like Brazilian Supreme Court Judge Alexandre de Moraes, who has clashed with X owner Elon Musk over disinformation crackdowns. The Trump administration has criticized allies like Germany and Britain for hate speech laws and the EU’s Digital Services Act, which U.S. tech firms like Meta claim amounts to censorship. For example, the UK threatened extradition of U.S. citizens for spreading misinformation online during 2024 riots, and Brazil’s actions against X have been a flashpoint. Rubio’s move follows his earlier closure of a State Department office accused of censorship and visa revocations for over 300 individuals, mostly students, tied to pro-Palestinian protests, signaling a broader crackdown on perceived threats to free speech. The policy’s implementation details and evidence standards remain unclear, raising concerns about enforcement consistency.
